Today is November 5 and I am Dennis Michael Lynch. Below are my opinions on the stories grabbing headlines this morning. I hope you share this briefing as doing so will make you the smartest person in the room, in my opinion.
1 – Biden admin considering vaccine mandate for businesses with fewer than 100 employees
Fox Business reports: The Occupational Safety and Health Administration (OSHA) says it is “seeking comment” about whether businesses with fewer than 100 employees should be subject to the COVID-19 vaccine and testing mandate it is implementing on big businesses.
OSHA’s requirement will force businesses with more than 100 employees to mandate vaccines or else their employees will need to wear masks and be tested for COVID-19 weekly. It will go into effect Jan. 4.
But according to a summary released by OSHA, it appears to be considering implementing the rule for small businesses as well.
“OSHA is confident that employers with 100 or more employees have the administrative capacity to implement the standard’s requirements promptly, but is less confident that smaller employers can do so without undue disruption,” the summary says. “OSHA needs additional time to assess the capacity of smaller employers, and is seeking comment to help the agency make that determination.”

2 – Job creation roars back in October as payrolls rise by 531,000
CNBC reports: The U.S. jobs market snapped back in October, with nonfarm payrolls rising more than expected while the unemployment rate fell to 4.6%, the Labor Department reported Friday.
Nonfarm payrolls increased by 531,000 for the month, compared to the Dow Jones estimate of 450,000. The unemployment rate had been expected to edge down to 4.7%.
Private payrolls were even stronger, rising 604,000 as a loss of 73,000 government jobs pulled down the headline number. October’s gains represented a sharp pickup from September, which gained 312,000 jobs after the initial Bureau of Labor Statistics estimate of 194,000 saw a substantial upward revision in Friday’s report.
The report comes amid heightened concerns about the state of the labor market, particularly a chronic shortage that has left companies unable to fill positions to scale back production and cut hours of operation.

3 – Activists swarm Joe Manchin’s Maserati as he tries to leave parking garage
The New York Post reports: A gaggle of far-left environmental activists followed Sen. Joe Manchin from his DC houseboat to his car Thursday morning and attempted to prevent him from leaving a parking garage — the latest fit of progressive pique over Manchin’s current opposition to the multitrillion-dollar Democratic social spending bill.
Video tweeted by John Paul Mejia, a spokesperson for the Sunrise Movement, showed Manchin (D-WV) walking from his houseboat on the Potomac River — where the senator rests his head when not in his home state — to the garage.
A second video, posted by Twitter user @Tim_Tweeted, showed small groups of activists standing in front of and behind the silver Maserati. Eventually, security guards who had accompanied Manchin to the car cleared a path for the senator to drive away.

4 – Newsom joins corrections department in appealing prison vaccine mandate
The Hill reports: California Gov. Gavin Newsom (D) is joining the state’s Department of Corrections and Rehabilitation in asking a federal court to pause an order requiring correctional staff to be vaccinated against COVID-19, the Los Angeles Times reported on Thursday.
The state is asking the Ninth Circuit Court of Appeals to pause the order pending appeal, arguing that implementing it would lead to a mass exodus of correctional officers, according to the newspaper.
U.S. District Judge Jon S. Tigar ruled in late September that employees looking to have “access” to corrections facilities — or incarcerated persons who desire to work outside of the institution or want in-person visitation — either be vaccinated or have a medical exemption.
On Oct. 27, the court ordered that those covered by the mandate be in compliance by Jan. 12.

5 – WATCH: Voters get brutally honest about why they’re joining Republicans
Fox News reports: A clip of a Hispanic Virginia voter telling Telemundo News that President Joe Biden played a factor in his vote for Republican Glenn Youngkin on his way to defeating Democrat Terry McAuliffe Tuesday night made the rounds on Twitter Thursday.
“I believe that Biden turned me into a Republican,” a voter told Telemundo. “Biden is destroying the economy, inflation is through the roof. Everything is terrible.”
Media Research Latino’s Jorge Bonilla predicted the clip “will become the subject of nightmares” for progressives in future elections. MRC Latino is a Spanish-language conservative watchdog launched by the Media Research Center.
